The insurance adjuster is not your friend!
We've all been there or know someone who is: You are driving along, when out of nowhere, BAM! You've been in a car accident. So many things go through your mind. Am I right? Does anyone else hurt? My car is right? Do I have to call the police? (The answer to that question, of course, is yes!)
In the hours or days after his car accident, is likely to talk to many people associate with an insurance company. You are always required to report any accident to your own insurance company and may decide whether the company wants to deal with insurance of the other person too. When you call and report the incident, most likely be contacted by an adjuster assigned to your claim. You can talk to a adjuster with your own insurance company and an adjustment of the person who caused the accident.
Without going into too much legal detail, just say that when you deal with someone related to your own insurance company, have many legal obligations to be honest and frank with you, and to treat as fairly and in good faith. It is very important to note, however, that these same requirements do not apply to the conduct of the adjuster of the person who caused the accident. This adjustment can be referred to as a "Third Party" setting, as they represent the "third" insurance company, which is sure the other party involved in the accident.
The duties and obligations of an insurance adjuster from a third party to deal fairly and in good faith are very limited under Texas law compared with the same rights as a "first part" of adjustment (an adjuster to your own insurance company.)
You will find often than liability adjusters are often very friendly and very sympathetic to your situation. They can offer a shoulder to mourn and encourage your talk freely about facts of the collision and his injuries. Many times people do not realize that the work of these regulators is to find reasons to deny your claim and pay you nothing (or as little as possible) for their injuries. These regulators can pretend to be his friend, but they are not. They are on their side, and are working against their interests.
As a personal injury lawyer, I often hired by clients who have first tried to manage their own claims. After all, the setting was so nice and friendly so, and promised it would be fair! The times and behold, weeks or months later, the cold hard reality sets in. Often in these situations, my client said or done things to make my work in the appropriate damage recovery much more difficult or even impossible.
My best advice is to remember that insurance adjuster for the other party in the collision is not your friend, no matter how much I want you to believe otherwise. If you are involved in a car accident, what is always best to consult an attorney who truly ALWAYS at her side.
